1. About these terms

These Terms of Use apply when you access or use SurveyForm, including the public website, account area, survey builder, published surveys, response collection tools, and export features. By using the service, you agree to these terms.

If you use SurveyForm on behalf of an organisation, you confirm that you are authorised to accept these terms for that organisation.

2. Accounts and access

You must provide accurate account information and keep your sign-in details secure. You are responsible for activity that occurs under your account, including surveys created, responses collected, and exports downloaded by users with access to your workspace.

We may suspend or restrict access where we reasonably believe an account is being misused, presents a security risk, or is being used in breach of these terms.

3. Your surveys and content

You retain ownership of survey questions, uploaded images, response data, and other content you create or collect through the service. You grant us the permission needed to host, store, display, process, secure, back up, and export that content for the purpose of providing SurveyForm.

You are responsible for ensuring that your surveys, collection notices, respondent instructions, and use of response data comply with laws that apply to you.

4. Acceptable use

You must not use SurveyForm to:

• collect information unlawfully, deceptively, or without appropriate authority;
• publish surveys that are abusive, discriminatory, misleading, defamatory, or unlawful;
• upload malware, malicious code, or content that infringes another person's rights;
• attempt to bypass security controls, access another user's account, or disrupt the service;
• send spam or use the service for unsolicited bulk messaging.

5. Respondents

Survey respondents should read any survey-specific information provided by the survey owner before submitting a response. The survey owner is responsible for the purpose of the survey, the questions asked, and how exported response data is used outside SurveyForm.

6. Availability and changes

We aim to keep SurveyForm available and working reliably, but we do not guarantee that it will be uninterrupted, error-free, or available at all times. We may update, change, suspend, or discontinue parts of the service where reasonably required for maintenance, security, improvement, or operational reasons.

7. Privacy and data

Our handling of personal information is described in the Privacy Policy. You must only collect personal information through surveys where you have a lawful basis to do so and have provided any notices or consents required for your use case.

8. Intellectual property

SurveyForm, the website design, application code, branding, and platform features are owned by us or our licensors. You may not copy, reverse engineer, resell, or commercially exploit the service except as permitted by these terms or with written permission.

9. Liability

Nothing in these terms excludes, restricts, or modifies any rights, remedies, guarantees, or warranties that cannot lawfully be excluded under the Australian Consumer Law or other applicable laws.

To the extent permitted by law, we are not liable for indirect, consequential, special, or punitive loss, loss of profits, loss of business opportunity, or loss arising from your survey content, respondent submissions, exported data, or misuse of your account.

10. Ending access

You may stop using the service at any time. We may close, suspend, or restrict an account if these terms are breached, if the service is misused, or if continued access creates a legal, operational, or security risk.

11. Governing law

These terms are governed by the laws of Australia and, where applicable, the state or territory in which the service operator is based. You agree to submit to the non-exclusive jurisdiction of the courts in that place.
